Etsy Infringements: How They Work

In order to assure Etsy Sellers are not infringing on each others goods, Esty.com has implemented an Intellectual Property Policy.

If you believe someone is infringing upon your work, their procedure requires you to submit a claim that provides details of the alleged infringement. If the claim submitted appears valid, Etsy.com will notify the alleged infringer by sending a DMCA take down notice (aka the Digital Millenium Copyright Act). The alleged infringing items will then be taken off the alleged infringer’s Shop by Etsy.com.

Etsy Infringement: The Process for Counter-Notices

Step 1: Etsy Infringement Assessment


We determine whether or not the infringement notice represents a valid claim by reviewing the materials you received from Etsy.com and researching the facts.

Step 2: Attorney Drafted Country Notice

Once we determine you have received the infringement notice in error, we draft a formal counter-notice in accordance with sections 512(g)(2) and (3) of the Digital Millennium Copyright Act.

Step 3: Notice Sent to Etsy.com

As your attorney, we will then send Etsy.com’s legal department the counter-notice on your behalf. Once Etsy.com receives the counter-notice they are given a statutory time frame to reinstate your goods.

Step 4: Once Approved, Etsy.com Reinstates Your Items

Once the counter-notice is received, Etsy.com has 14 business days to reinstate your goods unless the alleged copyright owner provides Esty.com evidence of an instituted action seeking a court order.
